The State Police Association of MA received a favorable labor arbitration decision concerning the civilianization of the Massachusetts State Police’s (“MSP”) detail office. The arbitrator found that MSP, via the civilian third-party company handling the distribution of details, violated the parties’ collective bargaining agreement. This case stands on the principle that employers cannot simply avoid contractual obligations when outsourcing to a third party. The MSP was ordered to work with the third party to make changes to bring the third party into compliance with the CBA and make effected members whole.
